Landlord Series - Notice of Termination (Part 6)

The Landlord Series are various tips to help the owner of a rental property become a better and more informed landlord.

In this series we explain the Notice of Termination (Part 6)

Today we are going to explain the Notice by a Mortgagee

When a landlord doesn't make their mortgage payments, a mortgagee may decide to foreclose on the rental unit. In spite of what a mortgage agreement may say, a mortgagee must follow the Residential Tenancies Act when giving a tenant notice to move. This applies even if a mortgagee doesn't collect rent from a tenant.

A mortgagee must honour any agreement between the landlord and tenant. A tenancy agreement survives a foreclosure. This policy applies even if the landlord had rented out the dwelling without the prior knowledge of the mortgagee.

Any termination notice by a Mortgagee follows the same rules as a landlord - if the property is being sold there must be three months notice, and only if a new owner or the owner's immediate family is moving into the residence for their own personal use.

Bank of Canada Predicts Economy Growth in 2010 and 2011

After the Canadian Economy shrank by 2.9 percent in 2009, the Bank of Canada announce yesterday they predict the economy will grow by 2.9 percent in 2010 and 3.5 percent in 2011.

Why the change? The Canadian Economy grew at a strong 5 percent pace in the fourth quarter, as reported by Statistics Canada on Monday.

The Bank of Canada also reiterated it's commitment to hold rates steady until the middle of the year, and announced yesterday that it is keeping it's benchmark lending rate at a record low of 0.25 percent.

The Bank also acknowledges that recovery seems to be proceeding at a better pace than it had anticipated.

Landlord Series - Notice of Termination (Part 5)

The Landlord Series are various tips to help the owner of a rental property become a better and more informed landlord.


In this series we explain the Notice of Termination (Part 5) - Tenant Not Meeting Obligation (other than Non-Payment of rent)

A landlord can end a tenancy when a tenant doesn't meet an obligation under the Act or a tenancy agreement. However, before a landlord can do this, they must provide the tenant with a change to correct the problem with a written warning.

Examples of problems: noise disturbances, garbage in their yard, grass is not cut, etc.

The landlord must allow the tenant a reasonable length of time to correct the problem. If the tenant does not change the problem, the landlord can give the tenant a Notice of Termination ending the tenancy agreement.

If a tenant doesn't move after receiving a notice of termination, the landlord may apply to the branch for an Order of Possession and file a claim for money that the tenant owes.
